O Tribunal Superior Eleitoral (TSE) recebeu ao menos 804 ações judiciais relacionadas à eleição presidencial de 2026 até a noite de ontem (21), de acordo com levantamento do site g1. O número supera em mais de duas vezes os registros feitos no mesmo período de 2022, quando foram contabilizados 325 processos, e de 2018, que teve 388.

O volume de disputas judiciais aumentou na reta final do 2º turno, com as campanhas de Lula (PT) e Flávio Bolsonaro (PL) levando ao tribunal questionamentos sobre redes sociais, distribuição de conteúdo pelo WhatsApp e uso de inteligência artificial na propaganda eleitoral.

Entre os temas em análise estão os critérios para vincular oficialmente canais de WhatsApp às campanhas e os limites para o uso de deepfakes, conteúdos produzidos com inteligência artificial que simulam pessoas ou situações com alto grau de realismo.

O tribunal ainda pode julgar 12 ações de investigação judicial eleitoral (AIJEs) já admitidas pelo corregedor-eleitoral, o ministro Ricardo Villas Bôas. Os processos apuram possíveis casos de abuso de poder político, econômico ou de autoridade e podem resultar em cassação de mandato e inelegibilidade.

Essas ações costumam ter tramitação mais longa por envolverem uma fase ampliada de coleta de provas. Juristas ligados às campanhas, consultados pelo site, estimam que os julgamentos ocorram mais perto das eleições de 2030.

As representações convencionais, por sua vez, tratam de questões cotidianas da disputa, como propaganda irregular e pedidos de remoção de publicações. Em geral, esses processos recebem decisões mais rápidas.

Mais de 800 representações foram protocoladas no TSE durante a campanha para denunciar irregularidades ou atos ilícitos que violem a legislação eleitoral. Esses casos só podem ser julgados pelos juízes auxiliares, integrantes do tribunal designados pela presidência.

O grupo é formado pela jurista Estela Aranha, pelo ministro substituto Marco Aurélio Bellizze, pelo vice-presidente do TSE, André Mendonça, e pelo presidente da Corte, Nunes Marques.

As campanhas de Lula e Flávio iniciaram disputas judiciais ainda no 1º semestre, antes do começo oficial da campanha eleitoral. Naquele período, as ações tratavam principalmente de propaganda eleitoral antecipada. Com o avanço da disputa, os questionamentos passaram a incluir divulgação de fatos inverídicos, impulsionamento de conteúdo negativo contra candidatos, realização de showmícios e conteúdo das propagandas eleitorais no rádio e na televisão.

O mandado de prisão foi cumprido, na tarde de hoje, pela Polícia Federal (PF), em Teresópolis. Bacellar foi levado para superintendência da corporação na capital fluminense.

Segundo a PF, ele teria vazado informações sigilosas sobre a investigação que envolve o deputado estadual TH Joias.

De acordo com a PF, Bacellar também foi alvo de uma medida de busca e apreensão.

A corporação também informou que a prisão e a buscas foram determinadas na Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 635, mais conhecida como ADPF das Favelas. Além de estabelecer medidas para o enfrentamento da letalidade policial no Rio, o processo investiga a ligação de grupos criminosos com agentes públicos.

Bacellar havia sido preso em dezembro do ano passado, mas, dias depois, uma votação da Assembleia Legislativa do Estado do Rio de Janeiro (Alerj) determinou a soltura dele. Diante disso, o ministro Alexandre de Moraes expediu o mandado de soltura de Bacellar.

Moraes entendeu que Bacellar deve voltar à prisão porque teve o mandato cassado na mesma decisão em que, na semana passada, o Tribunal Superior Eleitoral (TSE) condenou o ex-governador do Rio Claudio Castro à inelegibilidade.

O ministro também ressaltou que Bacellar foi denunciado pela Procuradoria-Geral da República (PGR) pelo crime de obstrução de investigação no caso do ex-deputado TH Joias.

“Desse modo, é patente a necessidade da decretação da prisão em face da conveniência da instrução criminal e para assegurar a aplicação da lei penal, bem como a ordem pública”, decidiu Moraes.

Em nota enviada à Agência Brasil, o advogado Daniel Bialski disse pretende recorrer da decisão que decretou a prisão do deputado.

“A defesa desconhece completamente os motivos dessa nova prisão decretada, mas ainda assim a classifica como indevida e desnecessária, já que nosso cliente vinha cumprindo fiel e completamente todas as medidas cautelares impostas. Portanto, irá contestar e recorrer para que seja revista e revogada o quanto antes”, afirmou.
