O mandado de prisão foi cumprido, na tarde de hoje, pela Polícia Federal (PF), em Teresópolis. Bacellar foi levado para superintendência da corporação na capital fluminense.

Segundo a PF, ele teria vazado informações sigilosas sobre a investigação que envolve o deputado estadual TH Joias.

De acordo com a PF, Bacellar também foi alvo de uma medida de busca e apreensão.

A corporação também informou que a prisão e a buscas foram determinadas na Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 635, mais conhecida como ADPF das Favelas. Além de estabelecer medidas para o enfrentamento da letalidade policial no Rio, o processo investiga a ligação de grupos criminosos com agentes públicos.

Bacellar havia sido preso em dezembro do ano passado, mas, dias depois, uma votação da Assembleia Legislativa do Estado do Rio de Janeiro (Alerj) determinou a soltura dele. Diante disso, o ministro Alexandre de Moraes expediu o mandado de soltura de Bacellar.

Decisão

Moraes entendeu que Bacellar deve voltar à prisão porque teve o mandato cassado na mesma decisão em que, na semana passada, o Tribunal Superior Eleitoral (TSE) condenou o ex-governador do Rio Claudio Castro à inelegibilidade.

O ministro também ressaltou que Bacellar foi denunciado pela Procuradoria-Geral da República (PGR) pelo crime de obstrução de investigação no caso do ex-deputado TH Joias.

“Desse modo, é patente a necessidade da decretação da prisão em face da conveniência da instrução criminal e para assegurar a aplicação da lei penal, bem como a ordem pública”, decidiu Moraes.

Em nota enviada à Agência Brasil, o advogado Daniel Bialski disse pretende recorrer da decisão que decretou a prisão do deputado.

“A defesa desconhece completamente os motivos dessa nova prisão decretada, mas ainda assim a classifica como indevida e desnecessária, já que nosso cliente vinha cumprindo fiel e completamente todas as medidas cautelares impostas. Portanto, irá contestar e recorrer para que seja revista e revogada o quanto antes”, afirmou.
